Department Acceptance of GMP Proposal. The Department and the Design-Builder shall meet to negotiate the terms of the GMP Proposal. If the GMP Proposal is acceptable to the Department, the Department shall submit the resulting GMP Amendment for review and approval by the Council for the District of Columbia (the “Council”) in the event it exceeds the previously approved not-to-exceed limit established in the Agreement by more than $1 million. In such event, the GMP shall not be effective until so approved and executed by the Parties.
