Common use of Dependent Child of Separated or Divorced Parents Clause in Contracts

Dependent Child of Separated or Divorced Parents. If two (2) or more Plans cover a person as a Dependent child of divorced or separated parents, benefits for the child are determined in this order: 1. If there is a court decree that would establish financial responsibility for the medical, dental or other healthcare expenses with respect to the child, the benefits of a Plan that covers the child as a Dependent of the parent with such financial responsibility shall be determined before the benefits of any other Plan that covers the child as a Dependent child; 2. Second, the Plan of the parent with custody of the child; 3. Third, the Plan of the spouse (stepparent) of the parent with custody of the child; 4. Finally, the Plan of the parent not having custody of the child.
