Common use of Deposit and Payment of Funds/Assumption of Liabilities Clause in Contracts

Deposit and Payment of Funds/Assumption of Liabilities. All funds that are to be paid for Claims in Classes 5 through 17 pursuant to the Plan Documents shall be paid to the Trust as depository. Notwithstanding any contrary provision of applicable law, the Trustee shall invest all funds that are deposited in the Trust as specified in the Depository Trust Agreement. All funds that are to be paid by the Settlement Facility pursuant to the Plan Documents shall be paid by the Trust. All liabilities and obligations that are to be assumed by the Settlement Facility pursuant to the Plan Documents shall be assumed by the Trust but only to the extent that funds to be paid to the Settlement Facility are available to satisfy the assumed liabilities and obligations.
