Common use of Depositor’s election Clause in Contracts

Depositor’s election. as to the method of distribution must be made at least thirty (30) days before the Required Beginning Date, which is defined as April 1 of the calendar year immediately following the calendar year in which the Depositor reaches age 70 1/2. If no election is made, the Custodian will make distributions over a period not to exceed the Depositor’s single life expectancy.
