Common use of Description of Real Estate Clause in Contracts

Description of Real Estate. Providing Purchaser shall first make the payments hereinafter set forth and perform the covenants hereinafter mentioned on the part of Purchaser to be made and performed, Seller and Beneficiaries hereby COVENANT and AGREE to cause merchantable title to the tract of real estate legally described on the attached “EXHIBIT A” which is made a part hereof by this reference (which Tract of Real Estate is hereinafter referred to as “Real Estate”) to be conveyed, in fee simple title, to Purchaser or to Purchaser’s nominee at the closing of this transaction.
