Common use of Design Submission to be Approved Clause in Contracts

Design Submission to be Approved. Where any design submission is required to be approved by Owner, then except as otherwise specifically stated in this Article: (a) Any further design or manufacturing work carried out pending receipt of such approval shall be entirely at Contractor’s risk; and (b) If such approval is not received, then all additional work shall be solely at the cost of Contractor and with no entitlement to an extension of the Contract Time. Provided, however, that if the design submission is in conformity with the requirements of the Contract, and Owner fails to give its approval within the required response time, then subject to otherwise complying with the requirements of the Contract, if as a result of such failure by Owner to respond, Contractor incurs additional costs and/or is delayed in its performance of the Work, Contractor shall be entitled to claim an increase in the Contract Amount and/or an extension of the Contract Time.
