Common use of Designated Senior Indebtedness Clause in Contracts

Designated Senior Indebtedness. The Borrower shall not designate, create or permit to exist any (a) Designated Senior Indebtedness (as defined in the Convertible Subordinated Note Indenture) and (b) Designated Senior Indebtedness (as defined in the New Subordinated Note Indenture), in each case other than obligations arising under the Loan Documents.

Designated Senior Indebtedness. The Borrower shall will not, and will not designatepermit any of its Subsidiaries to, create or permit to exist designate any (a) Indebtedness as "Designated Senior Indebtedness Indebtedness" (as such term is defined in the Convertible Senior Subordinated Note Indenture) and (b) Designated Senior Indebtedness (as defined in the New Subordinated Note Notes Indenture), in each case other than obligations arising under the Loan Documents.

The Borrower shall not designate, create or permit to exist any (a) Designated Senior Indebtedness (as defined in the Convertible Subordinated Note Indenture) and ), (b) Designated Senior Indebtedness (as defined in the New Subordinated Note Indenture) or (c) Designated Senior Indebtedness (as defined in the New Convertible Subordinated Note Indenture), in each case other than obligations arising under the Loan Documents.
