Designation and Principal Terms. (a) There has been created a Series of Notes to be issued in one Class pursuant to the Indenture and this Supplement to be known respectively as “TAL Advantage III LLC Series 2009-1 Floating Rate Secured Notes”. On the Restatement Effective Date, the Series 2009-1 Notes will have a maximum principal balance of Four Hundred Million Dollars ($400,000,000). The Series 2009-1 Notes will not have priority over any Series, except to the extent set forth in the Indenture or in the Supplement for such other Series. The Series 2009-1 Notes are designated as a Series of Warehouse Notes.
