Common use of Designation of Additional LC Issuers Clause in Contracts

Designation of Additional LC Issuers. From time to time, the Company may by notice to the Administrative Agent and the Lenders designate as additional LC Issuers one or more Lenders (or Affiliates of Lenders) that agree to serve in such capacity as provided below. The acceptance by a Lender (or an Affiliate of a Lender) of any appointment as an LC Issuer hereunder shall be evidenced by an LC Issuer Agreement, which shall be executed by such Lender (or Affiliate), the Company and the Administrative Agent and, from and after the effective date of such agreement, (i) such Lender (or Affiliate) shall have all the rights and obligations of an LC Issuer under this Agreement and the other Loan Documents and (ii) references herein and in the other Loan Documents to the term “LC Issuer” shall be deemed to include such Lender in its capacity as an LC Issuer.
