Common use of Designation of CBD Properties Clause in Contracts

Designation of CBD Properties. From time to time, the Company may designate one or more additional properties as CBD Properties by delivering an Officers’ Certificate, in substantially the form attached hereto as Exhibit B, to the Trustee (i) setting forth the name of such property and (ii) certifying that, in the good faith opinion of such officers, such property is located in the central business district of a CBD Market. Upon delivery of such Officers’ Certificate to the Trustee, such property shall be a CBD Property for all purposes of this Ninth Supplemental Indenture.

Designation of CBD Properties. From time to time, the Company may designate one or more additional properties as CBD Properties by delivering an Officers’ Certificate, in substantially the form attached hereto as Exhibit B, to the Trustee (i) setting forth the name of such property and (ii) certifying that, in the good faith opinion of such officers, such property is located in the central business district of a CBD Market. Upon delivery of such Officers’ Certificate to the Trustee, such property shall be a CBD Property for all purposes of this Ninth Fourteenth Supplemental Indenture.

Designation of CBD Properties. From time to time, the Company may designate one or more additional properties as CBD Properties by delivering an Officers’ Certificate, in substantially the form attached hereto as Exhibit B, to the Trustee (i) setting forth the name of such property and (ii) certifying that, in the good faith opinion of such officers, such property is located in the central business district of a CBD Market. Upon delivery of such Officers’ Certificate to the Trustee, such property shall be a CBD Property for all purposes of this Ninth Eighth Supplemental Indenture.

Upon delivery of such Officers’ Certificate to the Trustee, such property shall be a CBD Property for all purposes of this Ninth Sixteenth Supplemental Indenture.

From time to time, the Company may designate one or more additional properties as CBD Properties by delivering an Officers’ Certificate, in substantially the form attached hereto as Exhibit B, to the Trustee (i) setting forth the name of such property and (ii) certifying that, in the good faith opinion of such officers, such property is located in the central business district of a CBD Market. Upon delivery of such Officers’ Certificate to the Trustee, such property shall be a CBD Property for all purposes of this Ninth Thirteenth Supplemental Indenture.

From time to time, the Company may designate one or more additional properties as CBD Properties by delivering an Officers’ Certificate, in substantially the form attached hereto as Exhibit B, to the Trustee (i) setting forth the name of such property and (ii) certifying that, in the good faith opinion of such officers, such property is located in the central business district of a CBD Market. Upon delivery of such Officers’ Certificate to the Trustee, such property shall be a CBD Property for all purposes of this Ninth Tenth Supplemental Indenture.

From time to time, the Company may designate one or more additional properties as CBD Properties by delivering an Officers’ Certificate, in substantially the form attached hereto as Exhibit B, to the Trustee (i) setting forth the name of such property and (ii) certifying that, in the good faith opinion of such officers, such property is located in the central business district of a CBD Market. Upon delivery of such Officers’ Certificate to the Trustee, such property shall be a CBD Property for all purposes of this Ninth Eleventh Supplemental Indenture.

From time to time, the Company may designate one or more additional properties as CBD Properties by delivering an Officers’ ' Certificate, in substantially the form attached hereto as Exhibit BEXHIBIT C, to the Trustee (i) setting forth the name of such property and (ii) certifying that, in the good faith opinion of such officers, such property is located in the central business district of a CBD Market. Upon delivery of such Officers’ ' Certificate to the Trustee, such property shall be a CBD Property for all purposes of this Ninth Third Supplemental Indenture.. 27 ARTICLE THREE

Upon delivery of such Officers’ Certificate to the Trustee, such property shall be a CBD Property for all purposes of this Ninth Fifteenth Supplemental Indenture.
