DESTRUCTION OF OR DAMAGE TO THE PREMISES. In the event the premises are partially or totally damaged or destroyed by fire or other cause, the following will apply: (a). If the premises are totally destroyed by fire, earthquake or other casualty, this Agreement will terminate, as of the date on which the damage occurs. However, if the damage or destruction is the result of the negligence of the Resident, or his or her invitees, then the Agreement will not terminate, unless notice is given by the Landlord/Agent, specifying the termination date.
