Common use of Determination of a Facility Clause in Contracts

Determination of a Facility. BPA shall make a written determination as to what constitutes a single facility, for the purpose of identifying an NLSL, based on the following criteria: (1) whether the load is operated by a single end-use consumer; (2) whether the load is in a single location; (3) whether the load serves a manufacturing process which produces a single product or type of product; (4) whether separable portions of the load are interdependent; (5) whether the load is contracted for, served or billed as a single load under «Customer Name»’s customary billing and service policy; (6) consideration of the facts from previous similar situations; and (7) any other factors the Parties determine to be relevant.
