Common use of Determination of Pool Clause in Contracts

Determination of Pool. The Issuer will determine the Issue Date Pool Balance of, and specify the Mortgage Loans constituting, a Pool as of the Issue Date by listing the Mortgage Loans in that Pool on the Mortgage Loan Schedule. The Issuer may amend the Mortgage Loan Schedule to correct administrative errors at any time prior to the first Distribution Date. Thereafter, the identity of the Mortgage Loans included in the Pool will not change except that (a) Mortgage Loans may be paid off, purchased, liquidated, foreclosed upon, or become REO Property (as permitted and described in this Trust Agreement), (b) Mortgage Loans may be substituted as provided in Section 2.6, and (c) errors in data pertaining to the Mortgage Loans may be corrected at any time. Not later than the first Distribution Date, the Issuer will establish the final Issue Date Pool Balance of the Pool on the Books and Records.
