Common use of Determination of Rated Capacity Clause in Contracts

Determination of Rated Capacity. Rated Capacity shall be determined and adjusted to Contract Conditions based on performance tests conducted in accordance with testing procedures set forth in Appendix F. A performance test was conducted on or about the Commercial Operation Date. Following the Commercial Operation Date, performance tests may be conducted, at Seller's discretion or at Department's request, to re-evaluate the Rated Capacity, provided however, that Department may request a performance test not more frequently than annually, and provided further that Department shall pay any incremental costs (including Fuel costs) associated with any performance test conducted at Department’s request, which cannot be conducted when the Facility is scheduled to operate at full load pursuant to a Department Dispatch request.
