Common use of Determination of Responsiveness Clause in Contracts

Determination of Responsiveness. i) Prior to the financial evaluation of bids, the GAIL will determine whether each bid is substantially responsible to the requirements of the Bidding document. ii) For the purpose of this clause, a substantially responsible bid is one, which conforms to all the terms and conditions and specifications of the bidding document without material deviation or reservation. A material deviation or reservation is one which affects in any substantial way the scope, quality, or performance of the works or which limits in any substantial way, in consistent with the bidding document, the employer’s rights of contractor’s obligation would affect unfairly the competitive position of bidders presenting substantially responsive bids. iii) If a bid is not substantially responsive to the requirements of the Bidding documents, it may be rejected by the GAIL.
