Determinations Of A Material Violation Of Agreement Flow Schedules. If the procedures described in section 6.1.2 have been followed for an alleged Material Violation of Agreement Flow Schedules and a dispute remains regarding whether or not such a Material Violation of Agreement Flow Schedules occurred, then any Party to this Agreement may notify the Chief of the Division of Water Rights of the SWRCB that such Party believes that a Material Violation of Agreement Flow Schedules has occurred and ask the Chief of the Division of Water Rights to determine whether a Material Violation of Agreement Flow Schedules actually has occurred. The Party or Parties submitting such a request will include with the request copies of all of the notices and responses that were prepared under section 6.1.2 and any other relevant material.
