Common use of Determinations Under Sections 3.01 and 3 Clause in Contracts

Determinations Under Sections 3.01 and 3. 02. For purposes of determining compliance with the conditions specified in Section 3.01 and Section 3.02, each Lender shall be deemed to have consented to, approved or accepted or to be satisfied with each document or other matter required thereunder to be consented to or approved by or acceptable or satisfactory to the Lenders unless the Designated Agent shall have received notice from such Lender prior to the date that the Borrower, by notice to the Lenders, designates as the proposed Effective Date or Closing Date, as applicable, specifying its objection thereto. The Designated Agent shall promptly notify the Lenders and the Borrower of the occurrence of the Closing Date.

The Designated Agent shall promptly notify the Lenders and the Borrower of the occurrence of the Closing Date.
