Determining Lenders. Unless otherwise specifically provided (i) (including in Section 1.12 of the Intercreditor Agreement) the provisions of this agreement may be amended, modified, or waived, only by an instrument in writing executed by Borrower, Administrative Agent, and Determining Lenders and supplemented only by documents delivered or to be delivered in accordance with the express terms of this agreement and (ii) the other Loan Documents may only be the subject of an amendment, modification, or waiver that has been approved by Determining Lenders and Borrower.
