During the Development Phase, the Consortium Members may request ANP to change the Development Area in order to incorporate other plots from the Contract Area, as long as, cumulatively: one or more Deposits are verified to be extrapolating the Development Area; and the plots intended to be incorporated have not been relinquished by the Contractors in compliance with the provisions of the Agreement. The Development Area to be retained shall be the one included in the Final Discovery Assessment Report approved by ANP. The Consortium Members shall retain, of the Development Area, only the Field area approved by ANP in the scope of the Development Plan. The Contractors shall immediately return to ANP the remaining plots, pursuant to the provisions of paragraphs 3.4 and 3.5. ANP shall have one hundred and eighty (180) days of the date of receipt of the Development Plan to approve it or request the Consortium Members to make the modifications it deems applicable. If ANP does not reply within this term, the Development Plan shall be deemed approved, and ANP’s power/duty to demand revisions whenever necessary is not waived. If ANP requests modifications, the Consortium Members shall submit the modified Development Plan within the term determined by ANP, repeating the procedure provided for in this paragraph 15.9. Disapproval of the Development Plan by ANP, after applicable administrative appeals are ended, shall entail lawful termination of the Agreement regarding the relevant Development Area. Until the Development Plan is approved, the Consortium Members may not carry out any work or conduct any Operations in the Development Area, except upon the prior approval of ANP. The request for early Production shall be substantiated and observe the precepts for preserving oil resources, ensuring operational safety, and preserving the environment. Development Area. When making a proposal for the delineation of a Development Area and its associated Development Plan, the Contractor shall consider in priority the option which is the most favourable for the Government in terms of Profit Oil split.
Development Area a. The “development area” includes that portion of the Carolina North Tract identifies as the long- term development area set forth in Exhibit B of this Agreement. The development area designated by this section comprises approximately 228 acres.
b. Except as specifically provided within this Agreement no development shall be undertaken in the development area in areas identified as “open space,” “working landscapes,” or “recreational fields” on the site plan for the portion of the Carolina North Project subject to building development pursuant to this Agreement (Exhibit D). This restriction does not include development associated with walking paths, stormwater management, wastewater treatment, low impact recreational opportunities (and associated support structures), public art, community gardens, shallow groundwater recharge, native plant nurseries, native habitat for targeted species, and ecological research and learning activities.
c. The following land uses and activities within the development area that do not involve the construction or use of a building shall be subject to Town review and approval by the Manager (using the appropriate form for approval acceptable to the Town Manager) and shall only be undertaken in a manner consistent with the site plans set forth in this Agreement and any other applicable terms of this Agreement:
1) Roads with exterior connections (construction);
2) Roads with exterior connections (operation);
3) Work in any public right of way;
4) Surface parking areas with greater than 50 spaces; and,
5) Any work in a Resource Conservation District that is not within a conservation area as defined by Section 5.5.1 of this Agreement.
d. The land uses and activities set forth in Section 5.5.2(e) of this Agreement that do not involve the construction or use of a building may be undertaken within the development area in a manner substantially consistent with the site plans set forth in this Agreement and any other applicable terms of this Agreement. The University shall include a report of all such activities undertaken in the previous year in the Annual Report required by this Agreement.
e. The land uses and activities set forth in Section 5.5.2(f) in the development area that do not involve the construction or use of a building are not subject to this Agreement, provided any individual undertaking of the activity does not involve land clearing or grading of more than 20,000 square feet:.

During the Development Phase, the Concessionaire may request ANP to change the Development Area in order to incorporate other plots from the Concession Area in it, as long as, cumulatively: one or more Deposits are verified to be extrapolating the Development Area; and the plots intended to be incorporated have not been relinquished by the Concessionaire in compliance with the provisions of the Agreement. Development Area a. Subject to the terms and conditions of this Agreement, USI grants to Developer the right to establish U-Swirl Stores in the exclusive development area (the “Development Area”) specified in the Addendum to this Agreement (the “Addendum”), which is attached to this Agreement as Exhibit 1 and incorporated herein by reference. Developer accepts this grant and undertakes the obligation to develop and operate the U-Swirl Stores using the System and in compliance with USI’s standards. U-Swirl Stores in existence in the Development Area as of the Effective Date of this Agreement, if any, are excluded from Developer’s exclusive Development Area.
b. During the term of this Agreement, and provided that Developer is in full compliance with this Agreement and any other agreements entered into by Developer and USI, USI will not establish, or grant a franchise to a third party to establish, any U-Swirl Stores in the Development Area.
c. Each U-Swirl Store will be established and operated pursuant to a separate Franchise Agreement to be entered into between the parties. In this Agreement, the term “Franchise Agreement” means the then-current form of Franchise Agreement used by USI for granting franchises to franchisees, including area developers.
Development Area. A separate application for a Petroleum Production Licence and corresponding Development Plan shall be submitted for each Development Area.
Development Area. DEVELOPER shall establish and operate its FRANCHISED STORES solely in the geographic area set forth on Exhibit B attached hereto and incorporated herein by reference (the "Development Area"). DEVELOPER acknowledges and agrees that DEVELOPER is not granted any rights to develop or operate FRANCHISED STORES outside of the Development Area.
