Development Controls. The Property, at or prior to the Closing, will be made subject to and conveyed subject to those certain Covenants, Conditions, and Restrictions recorded as Instrument No. 00-352470 of the Real Property Records of San Bernardino County, California and dated September 27, 2000, as amended, and the Design Guidelines promulgated thereunder (collectively, the “Restrictive Covenants”). Purchaser shall cause all other properties acquired by Purchaser for the Project also to be made subject to the Restrictive Covenants promptly after acquisition thereof. This covenant shall survive the Closing.
