Development Fee Credits. All payments pursuant to Section 7.2.2.1, Section 7.2.2.2(a) and Section 7.2.2.2 (b), shall be deemed “Extension Payments.” In the event that Licensee pays Symphony the Development Fee pursuant to Section 4.3.3 prior to December 31, 2015, the Development Fee otherwise payable shall be reduced by *** of the sum of all Extension Payments received by Symphony.
Development Fee Credits. In consideration of ▇▇▇▇▇▇ agreeing to fund the Road Projects, and so long as ▇▇▇▇▇▇ has timely satisfied all obligations hereunder that are required to be performed as of the applicable date, the City and HIC agree that ▇▇▇▇▇▇ or any affiliate of Horton shall receive a credit reduction of $1,300.00 per Residential Dwelling Unit against Development Fees due under Article XI(F)(1) of the Development Agreement at the time of application for a building permit, provided that the total amount of said credits shall not exceed the funds to be paid by ▇▇▇▇▇▇ hereunder. ▇▇▇▇▇▇ will receive each credit by reducing the amount paid for each Development Fee at time of payment. The credits shall be accounted for as payments to the Off-Site Roadway Fund.
