Common use of Development of Competing Software Clause in Contracts

Development of Competing Software. The Marketing Agent shall not use the Software or Documentation or any Confidential Information (as defined herein) that it may acquire in connection with this Agreement to develop, have developed, or support or invest in, directly or indirectly, the development of any product which has, entirely or partially, the same functions as any of the Software or which would be in direct or indirect competition with any of the Software, or to sell competing products or services.
