The Deviations and Waivers clause allows parties to modify or excuse certain requirements or obligations set out in the agreement, either temporarily or permanently. In practice, this clause typically requires that any deviation from the contract’s terms or any waiver of a party’s rights must be made in writing and agreed upon by both parties, ensuring that informal or accidental waivers do not occur. Its core function is to provide a controlled mechanism for flexibility within the contract while maintaining clarity and preventing misunderstandings about the enforceability of the agreement’s terms.
Deviations and Waivers. In the event that a baseline design-related document requirement cannot be met, and a change to the baseline document is considered inappropriate, the Contractor shall submit a Request for Variance. The explanation of "need for deviation" should provide detailed justification and consequences of approval, to include technical details explaining the degree of non-compliance or effect on ship equipment or system operation constraints. In a similar manner, a waiver shall document an "as built" configuration that departs from baseline documentation and should include any proposed corrections or modifications to better meet the intent of the baseline document.
