Common use of Directed Unit Sales Clause in Contracts

Directed Unit Sales. None of the Directed Units (as defined in Section 6(o) below) distributed in connection with the Directed Unit Program (as defined in Section 6(o) below) will be offered or sold outside of the United States. None of the Abraxas Parties has offered, or caused the Underwriters to offer, Units to any person pursuant to the Directed Unit Program with the specific intent to unlawfully influence (i) a customer or supplier of the Abraxas Parties to alter the customer's or supplier's level or type of business with the Abraxas Parties, or (ii) a trade journalist or publication to write or publish favorable information about the Abraxas Parties or their operations.
