Common use of Disability; Death Clause in Contracts

Disability; Death. During any period that Executive fails to perform his duties hereunder as a result of Disability, Executive shall continue to receive his full Base Salary set forth in Section 5(a) and his full Bonus as set forth in Section 5(b) until his employment is terminated pursuant to Section 6(b). In addition, if Executive’s employment is terminated for Disability pursuant to Section 6(b), or due to Executive’s death pursuant to Section 6(a), in each case other than a Termination Following Change in Control:

Disability; Death. During any period that the Executive fails to perform his duties hereunder as a result of his Disability, the Executive shall continue to receive his full Base Salary set forth at the rate in Section 5(aeffect at the beginning of such period and continue as a participant in all compensation and benefit plans in which the Executive was participating pursuant to Sections 5(b) and his full Bonus as set forth in Section 5(b5(d) until his employment is terminated pursuant to Section 6(b7(a) or Section 7(b). In addition, if on or after the Effective Date Executive’s employment is terminated for Disability pursuant to Section 6(b), ) or due to Executive’s death pursuant to Section 6(a), in each case other than a Termination Following Change in Control:then the following shall apply.
