Common use of Discharge for Cause (Curable) Clause in Contracts

Discharge for Cause (Curable). Upon written notice to the Executive, the Company may terminate the Executive’s engagement for “Cause”, and with immediate effect, of any of the following events, if Executive has not cured the item that has been identified to be in breech within a thirty (30) day period: (i) the willful and continued failure or refusal of the Executive to satisfactorily perform the duties reasonably required of him as assigned by the Board of Directors; or (ii) the Executive’s material breach of a written policy of the Company or the rules of any governmental or regulatory body applicable to the Company In the event the Executive is terminated for Cause, the Company shall have no obligation to make payments to the Executive, except as otherwise required by law, for periods after the Executive's engagement with the Company is terminated on account of the Executive's discharge for Cause except for any accrued and unpaid compensation through the date of such termination.
