Common use of Discharge of Payment Obligation Clause in Contracts

Discharge of Payment Obligation. Each payment to the State by the trust fund shall discharge and satisfy the Agricultural Contractor’s obligation to pay the amount of such payment to the State. No reimbursement of the trust fund by the Agricultural Contractor for such payments shall be required. However, each Agricultural Contractor shall continue to make deposits to the trust fund matching the amount of each year’s reductions as provided in subdivision (d) of this article so long as the amount in that contractor’s account is less than its share of the Cap.
