We do not and cannot warrant that the e-statement service Services will operate without errorerrors, or that e-statement service any or all services will always be available at all timesand operational. Except as specifically provided in this Agreementagreement, or otherwise required by Lawlaw, you agree that our officers, directors, employees, agents, or contractors are not liable for any indirect, incidental, special or consequential damages under or by reason of any services or products provided under the Agreement this and or by reason of your use of the e-statement service, including loss of profits, revenue, data or use by you or any third party, whether in an action in contract or tort or based on a warranty or any other legal theoryaccess to Digital Banking Remote Deposit Services. Mutual Savings The Credit Union makes no warranty that: o shall be responsible only for performing the services expressly provided for in this agreement and shall be liable only for its negligence in performing those services. The service will be uninterrupted, timely, secure or error-free o The service will meet your requirements o The results that may be obtained from the use of the service will be accurate or reliable o The quality of any products, services, information or other material purchased or obtained by you through the service will meet your expectations o Any errors in the software will be corrected Mutual Savings Credit Union shall not be responsible for the member’s acts or omissions (including without limitation the amount, accuracy, or timeliness of transmittal) or those of any person, including without limitation any Federal Reserve Financial Institution or transmission or communications facility, and no such person shall be deemed the Credit Union’s agent. The member agrees to indemnify the Credit Union against any claims, damages, loss liability, or expense (including attorney’s fees and expense) resulting from or arising out of any claim of any person that the Credit Union is responsible for any act or omission of the member, or any other person described in this paragraph. In no event shall the Credit Union be liable for any direct, indirect, incidentalconsequential, special, consequential punitive, or exemplary damagesindirect loss or damage which the member may incur or suffer in connection with this Agreement, including but not limited towithout limitation, damages for loss of profits, goodwill, use data or other intangible losses resulting from: o The use or the inability to use the service o The cost of procurement of substitute goods and services damage from subsequent wrongful dishonor resulting from any goods, data information or services purchased from the service o Unauthorized access to your transmission o Unauthorized alteration of your data o Statements or conduct of the third party service provider o Any other matter relating to the service Mutual Savings Credit Union cannot control information on other websites. We are not responsible for the content or privacy of websites linked from Mutual Savings Credit Union’s websitesacts or omissions pursuant to this Agreement. Please review Without limiting the privacy policy generality of the service providerforgoing provisions, or the provisions of this Agreement, the Credit Union shall be excused from failing to act or from delay in acting if such failure or delay is caused by legal constraint, interruption of transmission or communication facilities, equipment failure, war, emergency conditions or other circumstances beyond the Credit Union’s control. In addition, the Credit Union shall be excused from failing to transmit or delay in transmitting a deposit if such transmittal would result in the Credit Union violating any provision of any present or future risk control program of the Federal Reserve or any rule or regulation of any other United States governmental regulatory authority. Notwithstanding any other provision set forth herein to the contrary, in the event of default under the terms of this agreement by the member, the Credit Union shall have all rights and remedies available at law or in equity.

We will send all notices, attachments and/or documents via e-mail to the use of the service will be accurate last known e-mail address provided by you. You agree to notify us promptly in writing (by letter sent via U.S. Mail) or reliable o The quality by calling us at 000-000-0000, of any productschange of your e-mail address. For your protection and for security purposes, serviceswe will not accept any change of e-mail address notices via e-mail. If you have not notified us of any change of your e-mail address, information or other material purchased or obtained you agree that your failure to provide us with a good e-mail address is the lack of ordinary care on your part. If we become aware that you are not receiving e-mail, we will send all notices, attachments and/or documents to you via U.S. Mail to your last address known to us. You will receive an e-mail shortly after the end of each statement period (not all accounts generate monthly statements) with your eStatement. The member agrees to indemnify the Credit Union against any claims, damages, loss liability, or expense (including attorney's fees and expense) resulting from or arising out of any claim of any person that the Credit Union is responsible for any act or omission of the member, or any other person described in this paragraph. In no event shall the Credit Union be liable for any direct, indirect, incidentalconsequential, special, consequential punitive or exemplary damagesindirect loss or damage which the member may incur or suffer in connection with this Agreement, including but not limited towithout limitation, damages for loss of profitsdamage from subsequent wrongful dishonor resulting from the Credit Union's acts or omissions pursuant to this Agreement. Without limiting the generality of the forgoing provisions, goodwillor the provisions of this Agreement, use data the Credit Union shall be excused from failing to act or from delay in acting if such failure or delay is caused by legal constraint, interruption of transmission or communication facilities, equipment failure, war, emergency conditions or other intangible losses resulting from: o The use circumstances beyond the Credit Union's control. In addition, the Credit Union shall be excused from failing to transmit or delay in transmitting a deposit if such transmittal would result in the inability to use the service o The cost Credit Union violating any provision of procurement of substitute goods and services resulting from any goods, data information present or services purchased from the service o Unauthorized access to your transmission o Unauthorized alteration of your data o Statements or conduct future risk control program of the third party service provider o Any Federal Reserve or any rule or regulation of any other matter relating United States governmental regulatory authority.
