Common use of Disclosure Excluded Clause in Contracts

Disclosure Excluded. If Xxxxxx was a mortgagee or a successor in interest to the mortgagee's secured position or a beneficiary under a deed in trust who has acquired the real property by deed in lieu of foreclosure, consent judgment or judicial deed issued pursuant to a foreclosure sale, or if Seller succeeded to the benefit of the § 46/20(2) exclusion, under 12 U.S.C. § 1821(d)(2)(A)(i) as set forth in Section 6.1 above, then Seller will NOT be providing the “Disclosure of Information on Radon Hazards” required by § 46/10(b) of the Radon Awareness Act but for the § 46/20(2) exclusion. Notwithstanding the foregoing and, under that circumstance, without any obligation to do so, Seller hereby advises Purchaser of the following:
