Common use of Disclosure for Management and Administration Clause in Contracts

Disclosure for Management and Administration. Business Associate may disclose PHI received by Business Associate in its capacity as a Business Associate of CCIU for the proper management and administration of Business Associate if (i) the disclosure is required by law or (ii) Business Associate (a) obtains reasonable assurances from the person to whom the PHI is disclosed that it will be held confidentially and used or further disclosed only as required by law or for the purpose for which it was disclosed to the person and (b) the person notifies the Business Associate of any instances of which it becomes aware in which the confidentiality of the PHI has been breached.

Business Associate may disclose PHI received by Business Associate in its capacity as a Business Associate of CCIU Covered Entity for the proper management and administration of Business Associate if (i) the disclosure is required by law or (ii) Business Associate (a) obtains reasonable assurances assurance from the person to whom the PHI is disclosed that it will be held confidentially and used or further disclosed only as required by law or for the purpose for which it was disclosed to the person and (b) the person notifies the Business Associate of any instances instance of which it becomes aware in which the confidentiality of the PHI has been breached.
