The Transportation Provider shall affirmatively disclose the details of any pertinent judgment, criminal conviction, investigation, or litigation pending against the Transportation Provider or any of its officers, directors, employees, agents, or subcontractors of which the Transportation Provider has knowledge, or learns of during the term of any Transportation Contract with MART.
