Disclosure Statement Approval Order. Not later than April 15, 2011, the Bankruptcy Court shall have entered an order in the Chapter 11 Cases approving the Disclosure Statement, in form and substance not inconsistent with the provisions of this Agreement and which otherwise shall be in form and substance reasonably satisfactory to Investor (the “Disclosure Statement Approval Order”), and the Company shall have complied with the Disclosure Statement Approval Order in all respects.

Disclosure Statement Approval Order. 2. On February 12, 2013, this Court entered the Disclosure Statement Approval Order, which, among other things, (i) approved the Disclosure Statement as containing adequate information within the meaning of section 1125 of the Bankruptcy Code, (ii) set March 21, 2013 at 9:00 a.m. as the date of the Confirmation Hearing and March 14, 2013, as the deadline for voting and objections to confirmation of the Plan (iii) and provided for notice of the Confirmation Hearing.
