Common use of Disclosure to Business Associates Clause in Contracts

Disclosure to Business Associates. Participant represents that it enters into written business associate agreements with various vendors (each a “Participant Vendor”) in connection with Participant allowing such Participant Vendor access to Participant’s Protected Health Information under which the Participant Vendor agrees to protect the confidentiality of the Protected Health Information being disclosed to the Participant Vendor. In any case where a Participant has a right to access or receive protected health information under the SHIN-NY Policy Guidance, the Participant may request that HEALTHeLINK transmit such information to a Participant Vendor of the Participant, and HEALTHeLINK may comply with such request, so long as the conditions set forth in subsections (a) through (e) are met. The Participant remains responsible for the actions of its Participant Vendors.
