Common use of Disclosures and Waiver Clause in Contracts

Disclosures and Waiver. 15.4.1.1 “AS IS”. Lessee acknowledges that it is currently in possession of the Premises and that Lessee or its predecessor-in-interest has continuously occupied and/or managed and operated the Premises since 1961. Lessee accepts the Premises in their present condition notwithstanding the fact that there may be certain defects in the Premises, whether or not known to either party to this Lease, at the time of the execution of this Lease by Lessee. Lessee hereby acknowledges that it has performed all investigations required by Lessee, including without limitation soils and engineering inspections, in connection with its acceptance of the Premises “AS IS”.
