Common use of DISCONTINUATIONS; NEW PRODUCTS Clause in Contracts

DISCONTINUATIONS; NEW PRODUCTS. Nothing in this Article or elsewhere in this Agreement shall preclude the Corporation from discontinuing the sale of any Product which the Corporation reasonably concludes is no longer profitable or otherwise feasible for the Corporation to sell, provided the Corporation gives the Dealer at least ninety (90) prior written notice of such discontinuation. If the Corporation shall desire the Dealer to carry and sell additional skylight products and associated accessories, the Corporation shall so advise the Dealer in writing, and the Dealer shall have thirty (30) from the date of such notice to determine whether it wishes to have such new skylight product and associated accessories, added to Exhibit "A" as a Product. If the Dealer so declines, the Corporation may sell the new product itself or through a Distributor or another Dealer or commission agent in the Territory.
