Common use of Discounts, Rebates and Refunds Clause in Contracts

Discounts, Rebates and Refunds. For purposes of determining the cost, if any, of any change, addition, or omission to the Work hereunder, all trade discounts, rebates, refunds, and all returns from the sale of surplus materials and equipment shall accrue and be credited to Developer, Developer shall make provisions so that such discounts, rebates, refunds, and returns may be secured, and the amount thereof shall be allowed as a reduction of Developer’s cost in determining the actual cost of construction for purposes of any change, addition, or omission in the Work as provided herein.
