Common use of Discovery and Clean-Up of Hazardous Material Clause in Contracts

Discovery and Clean-Up of Hazardous Material. Upon any Responsible Officer of Borrower receiving notice or becoming aware of any violation of Environmental Laws or any similar notice described in Section 11.10.2, or upon any Borrower otherwise discovering Hazardous Material on any property owned or leased by such Borrower which is in violation of, or which would result in liability under, any Environmental Law, Borrower shall: (i) promptly take such acts as may be necessary to prevent danger or harm to the property or any person therein as a result of such Hazardous Material; and (ii) take all necessary steps to initiate and expeditiously complete all removal, remedial, response, corrective and other action to eliminate any such environmental problems, and keep Lender informed of such actions and the results thereof.

Upon any Responsible Officer of Borrower receiving notice or becoming aware of any violation of Environmental Laws or any similar notice described in Section 11.10.26.02, or upon any Borrower otherwise discovering Hazardous Material on any property owned or leased operated by such Borrower Covered Person which is in violation of, or which would is reasonably likely to result in liability under, any Environmental LawLaw which is reasonably likely to have a Material Adverse Effect, Borrower shall: (i) promptly take such acts as may be necessary to prevent danger or harm to the affected property or any person therein as a result of such Hazardous Material; , and (ii) take all necessary steps to initiate and expeditiously complete all removal, remedial, response, corrective and other action to eliminate any such environmental problems, and keep Lender Administrative Agent informed of such actions and the results thereof.
