Discrepancy in Records. In the event the said inspection conducted under Section 3.11 herein reveals:
(a) any underpayment of royalties due to UHN, MBI will promptly pay UHN the full amount of that underpayment together with interest thereon at the rate of interest referred to in Section 3.7 herein; and
(b) any overpayment of royalties paid to UHN, UHN will promptly refund to MBI or credit MBI’s account, at MBI’s discretion, the full amount of that overpayment together with interest thereon at the rate of interest referred to in Section 3.7 herein.
Discrepancy in Records. In the event that the records inspection conducted under Section 4.12 reveals any underpayment of royalties due to UHN, Avro will promptly pay UHN the full amount of that underpayment together with interest thereon at the rate of interest referred to in Section 4.8. In the event that the records inspection conducted under Section 4.12 reveals any overpayment of royalties by Avro, the overpaid amount will be credited against future amounts payable to UHN.
Discrepancy in Records. In the event that the records inspection conducted under Section 3.14 reveals any undisputed underpayment of royalties due to UHN, Prothena will promptly pay UHN the full amount of the undisputed underpayment together with interest thereon at the rate of interest referred to in Section 3.10 herein. In the event that the records inspection conducted under Section 3.14 reveals any overpayment of royalties by Prothena, the overpaid amount will, in Prothena’s discretion, be credited against future amounts payable to UHN hereunder or promptly refunded to Prothena.
Discrepancy in Records. In the event that the records inspection conducted under Section 3.13 reveals any underpayment of royalties due to Institutions, TTI will promptly pay Institutions the full amount of that underpayment together with interest thereon at the rate of interest referred to in Section 3.9 herein.
Discrepancy in Records. In the event the said inspection conducted under Section 3.7 herein reveals any underpayment of royalties due to UHN, Licensee will promptly pay UHN the full amount of that underpayment together with interest thereon at the rate of interest referred to in Section 3.3 herein.
