Disposal of Construction Waste. The Contractor shall dispose of all waste materials in a legal and proper manner. Should the facilities of the New York City Department of Sanitation be used, waste material shall be disposed of in accordance with the rules and regulations of the New York City Department of Sanitation. The Contractor shall submit an affidavit to the Commissioner indicating compliance with said rules and regulations, list the site used, and provide proof of purchase of dump tickets. Should the Contractor use a site other than the New York City Department of Sanitation, the Contractor shall submit an affidavit to the Commissioner indicating compliance with all laws, rules and regulations for removal of waste material, list the site used, and provide a paid receipt. Failure to comply with this provision shall be deemed a material breach of this Contract.
