Dispostion of Network following Termination. Upon termination of this SUA for any reason, title to the Network (excluding any MMI-installed electronic equipment) and any related fixtures in the ODOT ROW shall pass to ODOT, and MMI shall, upon ODOT’s request, execute any documents reasonably necessary to document ODOT’s ownership in the Network. Following any termination, MMI shall remove any electronics from and cease use of the Network and, unless ODOT requests that MMI remove the Network, ODOT may use and permit others to use the Network and related fixtures in the ODOT ROW subject to the limitations and restrictions set forth in Section 1(F); provided, however, that if this SUA is terminated because the Parties failed to reach agreement on terms for the Renewal Term under Section 3(B), ODOT agrees that it will only use and permit others to use the ODOT Fiber portion of the Network.
