Dispute Resolution Arbitration Agreement. If you have any dispute or claim arising out of or relating in any way to this Agreement, please send an email to xxxxxxxxx@xxxxxxxxxxx.xx to resolve the matter via an informal, good faith negotiation process. You and we agree that all claims or controversies arising out of this Agreement, or any other acts or omissions for which you may contend that we are liable, including any claims or controversy as to arbitrability, that are not resolved within 30 days of sending such an email, will be finally and exclusively settled by arbitration under the LCIA Arbitration Rules in force at the time of the filing for arbitration of such dispute. The arbitration shall be held before a single arbitrator, unless either party requests three arbitrators, and shall be conducted in the English language. The arbitration proceedings and decision of the arbitrator(s) shall be kept confidential (and may not be disclosed) by the parties or the arbitrator(s), except to the extent necessary to compel any award made by the arbitrator(s). The arbitrator(s) may award declaratory or injunctive relief only in favor of the individual party seeking such relief and only to the extent necessary to provide relief warranted by that party's individual claim. The arbitration will be held in the Cayman Islands. Any award made by the arbitrator may be entered in any court of competent jurisdiction as necessary. Notwithstanding anything in this section to the contrary, either party will at all times be entitled to seek and obtain injunctive relief in relation to infringement or threatened infringement of its intellectual property rights or misappropriation of its trade secrets in any court having jurisdiction. This section shall survive termination of this Agreement.
