Dispute Resolution Relating to this Service. Any claim between you and Bank that arises under or in connection with this Service, or any transaction in connection herewith, shall be resolved in the manner set forth in our Deposit Account Agreement (as amended from time to time) as stated herein. Provided, however, if PaySimple is a necessary party to such claim between us, and if PaySimple does not agree to resolve such claim in accordance with our Deposit Account Agreement dispute resolution provisions, then such claim between us shall be resolved in accordance with the dispute resolution provisions of the Terms of Service.
