Common use of DISPUTES AND SETTLEMENTS WITH ACCOUNT DEBTORS Clause in Contracts

DISPUTES AND SETTLEMENTS WITH ACCOUNT DEBTORS. No credit, discount, allowance or extension or agreement for any of the foregoing will be granted to any Account Debtor without Burdale’s consent, except in the ordinary course of the Company’s business in accordance with proper practices and policies operated by the Company prior to the date of this Agreement. At any time while an Event of Default is outstanding, Burdale will, at its option, have the exclusive right to settle, adjust or compromise any claim, offset, counterclaim or dispute with any Account Debtor and to grant any credits, discounts or allowances in relation to such matters.
