Common use of Distribution Determination Clause in Contracts

Distribution Determination. In case of doubt as to whether a distribution should be made pursuant to this Article or the property recipient of a distribution pursuant to this Article, the Trustee in its discretion and at the trust’s expense may avail itself or the Reliance on Counsel provision in Paragraph 5.06 below, submit the issue to a court for determination, or take any other action to resolve the issue that the Trustee determines is advisable.
