DISTRIBUTION OF FINANCIAL STATEMENTS. MARINEMAX shall use its reasonable business efforts to prepare, publish and disseminate financial statements including at least thirty (30) days of combined operations of COMPANY and MARINEMAX after giving effect to the Merger and the transactions contemplated by the Other Agreements, to the end that the STOCKHOLDERS may thereafter sell the MARINEMAX Stock received in the Merger, without such sale violating the rules and regulations of the SEC.
