Distributions, Combinations and Subdivisions; Other Adjustments of Series 1 Preferred Units. Notwithstanding anything in Section 4.11 to the contrary, the Partnership will not (i) make a distribution on Series 1 Preferred Units in Series 1 Preferred Units, (ii) subdivide or split its outstanding Series 1 Preferred Units into a greater number of Series 1 Preferred Units, (iii) combine or reclassify its Series 1 Preferred Units into a smaller number of Series 1 Preferred Units, (iv) issue by reclassification of its Series 1 Preferred Units any Partnership Securities (including any reclassification in connection with a merger, consolidation or business combination in which the Partnership is the surviving Person) or (v) enter into or consummate any other transaction similar to those in clauses (i) through (iv) of this Section 4.13(l).
