Common use of Distributions to an Obligor Clause in Contracts

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 37 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 38 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the an Obligor or in accordance with Clause 35 29 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 39 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 34 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 32 (Set-Offoff)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so appliedDocuments.

The Facility Agent may (with the prior written consent of the Obligor referred to below or in accordance with Clause 35 32 (Set-Offoff)) apply any amount received by it for that an Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent and the Security Agent may (with the consent of the Obligor or in accordance with Clause 35 28 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

The Facility Agent and the Security Agent may (with the consent of the Obligor or in accordance with Clause 35 27 (Set-Offoff)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Senior Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the relevant Obligor (or in accordance with Clause 35 33 (Set-Offoff)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Senior Finance Documents or in or towards purchase of any amount of any currency to be so applied.

The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 34 (Set-Offoff)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so appliedDocuments.

The Facility Agent may (with the consent of the Obligor Company or in accordance with Clause 35 33 (Set-Set Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor Borrower or in accordance with Clause 35 28 (Set-Offoff)) apply any amount received by it for that Obligor the Borrower in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor the Borrower under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 30 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 40 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 32 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 31 (Set-Offoff)) apply any amount received by it for that any Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under any or all of the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the an Obligor or in accordance with Clause 35 38 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of as soon as reasonably practicable after receipt) of any amount due from that Obligor under the Finance Documents or Documents. For this purpose the Facility Agent may apply the received sum in or towards the purchase of any amount of any currency to be so appliedpaid.

Distributions to an Obligor. The Facility Facilities Agent may (with the consent of the Obligor or in accordance with Clause 35 (Set-Offoff)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause clause 35 (Set-OffSet­-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 clause 34 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 clause 33 (Set-Set- Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 clause 30 (Set-Offoff)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 32.10 (Set-OffSet off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

The Facility Agent may (with the consent of the Obligor Obligors or in accordance with Clause 35 34 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 clause 31 (Set-OffSet off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor Borrower or in accordance with Clause 35 31 (Set-Off)) apply any amount received by it for that Obligor Borrower in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor Borrower under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent and Security Agent may (with the consent of the Obligor or in accordance with Clause 35 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 (Set-Set- Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 31 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

The Facility Facilities Agent may (with the consent of the Obligor or in accordance with Clause 35 34 (Set-Offoff)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause clause 35 (Set-Set- Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 (Set-OffSet­Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 (Set-Off)Borrower's consent) apply any amount received by it for that an Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied, in accordance with Section 23.2 (Distributions by the Facility Agent).

Distributions to an Obligor. The Each Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 26 (Set-Offoff)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 15.2 (Set-Offoff)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the an Obligor or in accordance with Clause 35 31 (Set-Offoff)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of as soon as reasonably practicable after receipt) of any amount due from that Obligor under the Finance Documents or Documents. For this purpose the Facility Agent may apply the received sum in or towards the purchase of any amount of any currency to be so appliedpaid.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 29 (Set-Off)) apply any amount received by it for from that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or or, in the event that such receipts are not in US Dollars, in or towards purchase of any amount of any currency US Dollars to be so applied.

Distributions to an Obligor. The Facility Agent may (with the consent of the Obligor or in accordance with Clause 35 36 (Set-Off))) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of receipt) of any amount due from that Obligor under the Finance Documents or in or towards purchase of any amount of any currency to be so applied.

The Facility Agent may (with the consent of the an Obligor or in accordance with Clause 35 33 (Set-Off)) apply any amount received by it for that Obligor in or towards payment (on the date and in the currency and funds of as soon as reasonably practicable after receipt) of any amount due from that Obligor under the Finance Documents or Documents. For this purpose the Facility Agent may apply the received sum in or towards the purchase of any amount of any currency to be so appliedpaid.
