DIVERSION OF RECHARGE WATERS. The Pueblo may divert surface waters from the Rio Pueblo de Taos in an amount not to exceed one thousand (1,000) AFY from October 1 through March 15 of the following year for purposes of the Buffalo Pasture Recharge Project. Such diversions shall be measured and shall not be made in a manner detrimental to downstream surface water rights. Such diversion shall not constitute a water right, is independent of the Pueblo’s water rights described in Article 5, and shall be subject to the provisions of Article 7.3.1.4.
