Divulgation obligatoire. Si la Partie destinataire ou l'un de ses Représentants est prié, légalement contraint (par voie de questions verbales, d'un interrogatoire, d'une demande d'informations, d'une citation à comparaître ou d'une autre procédure légalement contraignante) ou tenu, par une instance de régulation, de divulguer de quelconques Informations confidentielles de la Partie divulgatrice, la personne recevant une telle demande xxxxx en aviser la Partie divulgatrice dans les meilleurs délais afin que cette dernière puisse demander le prononcé d'une ordonnance visant à protéger ses intérêts et/ou renoncer au respect des stipulations du présent Contrat. Si, à défaut d'une telle ordonnance ou d'une telle renonciation, la personne concernée est, de l'avis de son conseil, contrainte de divulguer de quelconques Informations confidentielles de la Partie divulgatrice à une juridiction ou un organisme quelconque, faute de quoi elle serait accusée d'outrage au tribunal ou s'exposerait à une autre condamnation ou sanction, la personne en question pourra divulguer les Informations confidentielles concernées sans encourir de responsabilité ; il est toutefois précisé qu'avant de procéder à une telle divulgation, ladite personne xxxxx déployer des efforts raisonnables afin de s'assurer, de manière fiable, que les Informations confidentielles ainsi divulguées shall be accorded confidential treatment and shall provide the Disclosing Party with a copy of any Confidential Information so disclosed.
