Documentation Verifying HIPAA Compliance 164. 504(e)(2)(ii)(H). Business Associate will make its policies, procedures, and documentation relating to the security and privacy of PHI, including EPHI, available to the Secretary of Health and Human Services for purposes of determining KDADS’ compliance with 45 C.F.R. Parts 160 and 164. Business Associate will make these same policies, procedures, and documentation available to KDADS or its designee upon request.
